General conditions of use.

These general conditions of use applies to all services provided by eXtreme Soft Group S.R.L, hereinafter referred to as ESG, through NORC sites.

NORC services mean all software, web services, content and features available to the users through NORC sites.

If the services require specific conditions of use, these conditions will be found as services specific terms of use and will complement the general conditions of use.

When contradictions between the general and specific terms of use of a service occur, the rules stipulated in the specific terms of use will apply.

Before using NORC services, users must read and accept these general conditions of use and the specific terms of use, where appropriate.

Acceptance of these conditions can be made by express acceptance in the user interface, where this option is available or by simply use of the services.

If the NORC services include content or services provided by third parties, users must comply also with the conditions of their specific use.

NORC sevices are used according to their availability and based solely on the decision of each user.

ESG has the right to prohibit the access to NORC sites or services, to any user who does not meet the general conditions of use.

1. Providing services to users and conditions of use.

ESG, through NORC sites, offers a variety of services.

Functionality, content and access interface of NORC services are decided exclusively by ESG and should be understood and used by users as provided by ESG.

To access and use certain NORC services, it may be necessary to create an access account which contains personal identification data provided by users. All these data, such as but not limited to name, surname or e-mail are subject to the privacy policy of ESG.

The user is solely responsible for maintaining the confidentiality of access data, such as but not limited to password and user name, used to access their accounts and ESG cannot be held responsible for any losses arising from unauthorized access. Also, the user is solely responsible for all activities conducted in his account. The access of a user account without prior acceptance from him is denied.

ESG can modify, add or discontinue temporarily or permanently, some features of the service or services entirely, without the need for prior notice to users.

These services can be provided in certain situations by third-party companies established or contractualy designated by ESG.

Users can opt to quit using any NORC services for any reason, without the need for prior information of ESG.

ESG do not guarantee that sites and / or NORC services will:

- fully meet the needs of users

- operate without interruption and without errors

- make changes of the services according to any user request and will correct any error appears.

It is prohibited:

- duplication, copying, resale or rental of NORC services in whole or in part, without prior written consent of ESG.

- to use of services in a contrary manner to the laws in force or which may direct or indirect harm the others.

- any action that may directly or indirectly cause changes or interruptions in providing services to users.

2. Content of the services.

Through NORC sites and services, ESG offers various forms of content such as, but not limited to images, geographic informations, informations about third party individuals or legal persons or other information about them.

This content can be published directly from ESG, by its licensors or by NORC users.

ESG has the right to refuse adding or to delete or foribid the access to any content that violates the terms of use or NORC service or any legal provisions in force.

Users must understand that it is their own decision to access and use the NORC services and must take into account that it is possible to access content that, personally, may consider inappropriate.

2.1 1. The content published by ESG and its licensors.

Any content published by ESG through NORC service is protected by copyright, under the laws in force related to intellectual property rights. These rights belong to either ESG or its licensors.

By accessing and using the content through NORC services, none copyright is transfered to users.

Any content provided by ESG through NORC services is for information purpose and users must take into account that the actual situation may differ from the information presented on NORC sites.

ESG has the right to amend, update, delete or replace any of its copyrighted content at any time and for any reason, without notice.

Also, ESG reserves the right to insert advertising content in any of the NORC sites or services. Responsibility for the content copyright regarding advertising, belongs entirely to those who provide this content to ESG.

2.2.Content submitted by users.

The user warrant ESG that he own the copyright of the content that he submitted in the NORC sites or services. By publishing this content on NORC sites, the user retains all his copyright and gives ESG the right to publish, to obtaine derivative works and distribute this content through NORC sites and services and also to use this content to promote NORC sites and services.

Also the user accepts that ESG can make any necessary changes of the submitted content so it becomes compatible with the technical requirements of specific environments or interfaces where it will be published.

The user is solely responsible for the quality and accuracy of the content he added to NORC websites and / or services.

Also, the user understands and agrees that it is prohibited to publish content which is:

- sexually explicit

- scurrilous, defamatory, threatening

- harassing or instigates to hatred

- discriminatory or xenophobic

- intentionally distorts facts and their publication may prejudice to third parties

- contrary to any legal provisions.

If users consider that the content of the NORC sites are contrary to the terms of use, they can address the ESG to: .

3. Responsibilities and guarantees.

Users understand and accept that ESG can not be held responsible for any loss or damage of any nature, that users may suffer, directly or indirectly as a result of:

- access and use NORC sites and / or services.

- modification or temporary or definitive interruption, in whole or in part of any of the NORC sites and / or services - published content on or within the NORC site and / or services

- users failure to ensure the obligation of maintaining confidentiality of any information that can permit unauthorized access to users accounts

- providing incorrect or incomplete information to ESG.

Applicability of the general conditions of use.

These terms of use may change with time. Any changes that will occur will be found in the document on this page. Each variant of the terms of use will have clearly indicated the date from which it applies.
